Is Coffee Taxable?

The bag of beans and the hot cup are two different products to a tax collector. Coffee you brew at home — beans, ground, instant, pods — is grocery food, exempt or discounted in almost every state that spares groceries. The cup handed across a counter is prepared food, taxed nearly everywhere. The fun is in the exceptions.

The carve-outs worth knowing

  • California exempts the hot cup too: a hot coffee sold to go, by itself, for a separate price is not taxed under Regulation 1603 — it becomes taxable only when bundled with a meal or hot food.
  • Ohio's rule turns on where you drink it, not how hot it is: a plain coffee carried out the door is exempt food. Sweeten it without milk, though, and it becomes a taxable "soft drink."
  • New York draws the line at the cup: beans, grounds, instant — even bottled iced coffee — are exempt, but any coffee "sold and served in a cup," hot or iced, is taxed.
  • Texas is the everything-counter-side rule: packaged coffee is a tax-free grocery; coffee sold hot, or in a cup or glass or with a straw, is taxable.
  • In the grocery-rate states the bag of beans pays the discount rate: 2% in Alabama, 5% in Mississippi, 1.225% in Missouri, 4% in Tennessee, 3% in Utah, 1% in Virginia.

Is the coffee I buy at the grocery store taxed?

Almost never at full rate. Beans, ground, instant, and pods count as grocery food: fully exempt in most states, discounted in the grocery-rate states (Alabama, Mississippi, Missouri, Tennessee, Utah, Virginia), and fully taxed only in Hawaii, Idaho, and South Dakota — the states that tax all groceries.

Why is my coffee-shop cup taxed when the beans aren't?

The cup is prepared food — brewed, heated, and served by the seller — and nearly every state taxes prepared food even where groceries are exempt. Some states charge it a premium: 8% in Maine, 9% in Vermont, 7.35% in Connecticut, 8.5% in New Hampshire.

Where is a to-go coffee NOT taxed?

California — a hot coffee sold alone, to go, for a separate price is exempt under Regulation 1603 — and Ohio, where any plain coffee consumed off the premises is exempt food. In both, bundling it with hot food or drinking it on-site brings the tax back.

Is iced or bottled coffee treated differently?

Sometimes. New York exempts bottled iced coffee while taxing any coffee served in a cup. Ohio taxes sweetened coffee drinks without milk as soft drinks. Sweetened ready-to-drink coffee can fall into a state's soft-drink definition even where plain coffee is fine.
